Residencia fiscal: Tax residence
Understand residencia fiscal, what to check and the practical steps to take.
What does it mean?
Tax residence determines which tax rules apply to you as a resident or non-resident. Spanish residents and non-residents have different income-tax obligations, subject to applicable treaties.
A NIE, padrón entry or immigration document alone is not a complete tax-residence assessment.
An everyday example
Moving partway through a year is a reason to seek an assessment, not simply split the year yourself.
What to do next
- Record your travel dates and where you live during the relevant year.
- List your work, income, family and economic connections across countries.
- Ask a qualified cross-border tax adviser to assess the facts and any treaty.
- Keep the evidence supporting the conclusion with your tax records.
A useful question to ask
Which country treats me as tax resident for this year, and how does the treaty apply?
